The Demise of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the tension sparked by the introduction of a new 28-point plan for ending the war appeared – temporarily – to have been contained. A American diplomat spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: an extensive attack of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The chain of contrasting events captured the grim essence of the outgoing year. By day, negotiation efforts are waged: optimistic declarations are issued from various governments. Considerable effort is expended on managing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, conflict continues to be the main instrument for achieving "resolution".

Nocturnal Warfare

As Russia's attack unfolded into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was laid bare. Ukraine is able to track rocket firings from Russian territory, a ability enabled by timely intelligence. From observation points, military aircraft that had been deployed to intercept incoming cruise missiles flew past – advanced fighter aircraft delivered to Ukraine by Western partners.

Shortly after, Kyiv's air-defence systems activated: multiple launches fired to intercept a incoming threat. This was a sophisticated defense system at work, most likely delivered by allied countries. Every deployment shakes the surroundings, causing tremors. The moment of terror quickly gives way to grim resignation: maybe the incoming missile won't cause damage this time, sparing the city from devastation and further power outages.

Persistent Threats

Not long after, a large-caliber weapon opened up on a aerial vehicle close by, part of a mobile-fire group – probably allied-provided weaponry. Regrettably, the projectiles didn't strike the enemy aircraft – it maintained course toward its destination.

With pauses, this continued until dawn. Kyiv awoke to the morning news: several casualties, damage and utility failures in multiple buildings as a result of the evening attack. As always, everyone still went about their day – living the war. But those 24 hours encapsulated Ukraine's essential dependence on external assistance – a dependence that neighboring countries are clearly incapable to substitute in the near term.

Ineffective Peace Efforts

The 28-point plan from Washington generated strong feelings, discussion and profound anxiety – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and multilateral gatherings.

Every new approach from US leadership follows the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually secure success. This pattern will, undoubtedly, endure.

Political Considerations

It is easy to blame particular leaders of consistently pushing Russian terms. But that does not seem to be the complete picture. American leadership operates on a principle familiar among seasoned negotiators: you cannot achieve through diplomacy what you have been unable to protect through force. The US administration believes that it is impossible to pressure the Kremlin to relinquish the territory that it already controls in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, Washington does nothing to deter Moscow, through statements or actions, from thinking that the current condition will not change more in its benefit in the near future.

Opposing Positions

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its partners are nearing depletion. Their reason to agree to terms that does not give them the maximum possible gain is almost completely absent. There may be many attempts to achieve ceasefire, but they will carry on as long as Russia's leader remains completely certain in the outcome.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing lives and land but preventing a total frontline collapse until circumstances change in its advantage.

Current Realities

Factually, there are no real preconditions for a truce. Now, subjective factors are coming into play: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and Kyiv's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unacceptable, so that their attention does not shift toward domestic problems. And although their mission will now be much harder after recent developments, it remains very improbable that this will modify their basic position.

These two forces are influencing discussions.

Assessment and Future

It took a only one week to terminate the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by Washington, pushback by Ukraine and the remaining European nations, along with pacifying measures of negotiators, and finally, current information leaks, all achieved their purpose.

While new plans based on old ideas are approaching, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to counter political attacks from Washington that are founded on Moscow's terms and reflect certain reluctance to modify developments, if they remain united and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the coming months, primarily depend on sustained allied backing.
